Malicious and Brutal Nature of Indian Police.

The Police Forces all around the World has been known to the use of Lethality in one instance or another, Forces of Asian nations use them in the daylight due to their Legal structure and Public tolerance. The Western countries like the United State of America are also known for their Self-Defense play, there have been many instances when the Innocents have been killed just because they were trying to remove their cell-phones or Identity Cards from their jacket and the police thought they were about to remove their arms and shoot. The shooting of innocents also the blacks, in the name of self-defense has been a reason for many movements into the State.

The commonwealth Human rights initiative,2005- the Standard and Procedure for Crowd Control cites that the Use of Force should be only in extreme situations with a proper warning and the lethality should be of soft nature. The Use of Tear Gas has also caused many problems to the protesters in long run, also the Standard which states that the lathi-charge should be made after a warning Siren and then soft blows should be made in some parts of the body, which have more presence of fats soo it would not cause harm. Also the upper body parts like collarbone and the head part should not be touched, but in most situations the force never looks at the body parts during the Laathicharge, they just blindly and freely move their laathi's irrespective of injury in someone's face or abdomen part. The usage of Teargas and water cannon should be also with proper measures and it should be launched at some distance from the crowd so that it will affect them but it won't cause any harm during the recovery. But they are notorious for throwing near them soo they would hurt and many had critical situations during the Teargas. 
Many protestors have survived the Laathicharge with Several fatal head injuries, many carried it till their deaths.
Interrogation during the Detention.

As soon as one is arrested, he is taken to the Police Station and within 24 hours is to be produced to the Magistrate. Then the Magistrate decided to keep him in the Police custody (Remand) for the investigation and then he is produced again before a magistrate after the Police custody and then as per the investigations and the evidence collected he is sent to Judicial Custody (Prison) or again to Police Custody to finish the Investigation. He can apply on bail during the period, but the approval depends on the circumstances. Police custody is mainly for a maximum of 14 days but can be extended upon the nature of the crime. The Remand is feared by even deadly gangsters. The Bollywood has portrayed the Remand of Police at a deadly level, like making sleep on ice and sprinkling salts. But the real scenes are not that deadly, but yes they are of very violent nature if one does not confess the crime. The belts and the Laathi are beaten in such a way that maximum pain will occur but still the areas won't show any signs. Though sometimes the beatings are seen during the regular medical examination during the Police Remand and the Sessions of Magistrate. The Law does not allow the police officers to beat or use any kind of Torture methods during the investigation methods, they are instructed to use the psychological tricks but as they are time-consuming and the duty sometimes cause patience to lose they try to use the physical pain as it would hurt them and they would confess it faster. The Method of not letting sleep and disturbing the sleep also is useful during the Interrogation. The Non-violent Interrogation techniques of Some Western Nations practice these tactics, rather than almost killing them in the custody. 


Custodial Deaths and Human rights Violence.

Chapter V of CrPc addresses arrests by police. Section 46 in which it allows police to use "All means necessary" to make the arrests. The AFSPA ( Armed force Special powers Act) gives them to use force in special circumstances. The use of excessive force also proves the killing in many reports. 
The total number of Custodial Deaths during the Detention is never shown as the Senior police officials and the Medical professionals alter the mistakes of their junior officers and also it makes the case look weak. They sometimes make them orchestrate as a suicide attempt, but how can one attempt a successful suicide within the reach of officers in a police station while on remand. The National Crime Records Bureau (NCRB) which reports and publishes the records of crimes, in their report of 2017 showed that around 100 persons died during Police custody. The latest reports of previous years are not yet updated. 

The Custodial Rapes are also a cause for concern, there had many cases of rapes in custody. One of them is Rameeza Bee who was raped by three policemen and his husband was killed too. This created a nation-wide movement against the rape in custody. A commission was set up and all the culprits were jailed but later they were acquitted by sessions court stating that the commission's judgment is inadmissible. 

On October 27, 2019 26-year old Vijay Singh died in Mumbai's Wadala truck terminal police station. He was arrested because he pointed his bike's headlight into a couple seating. His family later complained that he was having chest discomfort due to his injuries in the interrogation. 

The Hyderabad Gang Rape case, was very inhuman and the culprits should be given the toughest sentence. But the Police showed their Prejudice in it. To reconstruct the story, the police in the early morning took all the four culprits to the crime scene. But the police said they were not handcuffed and thus they tried to took the police's weapon and thus in self-response they killed them. But this proves the same pattern they use in extra-judicial encounters. In fact there is no Section in the law that approves the encounter. Its the police which created that. So the culprits were not Handcuffed and the hoisters of the police were soo loose that the culprits can remove the weapon anytime? The whole nation congratulated the act of encounter by the police, but will the extra-judicial killing stop the rapes and crimes? In fact it will create a sense of terror towards the police and also it will make the judicial process inferior to the Police systems of prejudice.


The Duty of the Police is to protect its citizens and also to arrests the culprits, after arresting their duties are to produce before a magistrate and also make a case with their Investigations with they got by peaceful means. Their duty finishes as soon as the accused is sent to jail and from there it is the duty of jail police. But due to the egoistic nature and the peer as well as socio-political pressure they are forced upon to make their case strong by torturing as well as by fake-confessing of the crimes by violent means. As the court of law has to look at both sides and then make a judgment, out of which if the police fail to procure proper investigation and proof then the person is acquitted and this also makes them inferior in the eyes of the outside world. The police in real terms of the judiciary just acts as a medium between the Justice and the unjust; they should not be a judicial system themselves. The prison systems are also another drawback, the majority of them are built during British-era and in comparison to the then population of the nation, not of the current population. There is a presence of limited resources in the prisons as well as the over-crowding in them. Until some time, even the fans were present in the prisons. Imagine yourself in the tropical climate rotting in an overcrowded prison with 500 other stuffed inside a small hollow structure.
